Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Report Grader service (“Service”), including the AI Report Grader demo and related websites and applications, operated by Fig AI Systems LLC (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance and Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. We may update these Terms from time to time; continued use after changes constitutes acceptance of the revised Terms.

2. Description of the Service

The Service provides AI-powered report grading and analysis. We use automated systems, including machine learning and large language models, to process content you submit and return analyses, scores, and feedback. The Service is provided “as is” and may be modified, suspended, or discontinued at any time. We do not guarantee availability, accuracy, or fitness for any particular purpose.

3. AI and Automated Processing

3.1 Use of AI

The Service relies on artificial intelligence, including third-party AI models and APIs. Outputs are generated automatically and may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and validating any results before relying on them for decisions.

3.2 No Professional Advice

The Service does not provide legal, medical, educational, or other professional advice. AI-generated feedback and scores are for informational and assistive purposes only and do not replace human judgment or qualified professional evaluation.

3.3 Acceptable Use of AI Outputs

You may not use the Service or its outputs to: (a) violate any law or regulation; (b) infringe intellectual property or privacy rights; (c) generate misleading or fraudulent content; (d) harass, defame, or harm others; (e) attempt to reverse engineer or extract training data from the AI systems; or (f) use the Service in any way that could damage, overburden, or impair the Service or our infrastructure.

4. Your Data and Content

4.1 Your Content

You retain ownership of content you submit to the Service (“Your Content”). By submitting Your Content, you grant us a limited, non-exclusive, royalty-free license to use, process, store, and transmit Your Content solely to provide, operate, and improve the Service and as described in our Privacy Policy.

4.2 Data Processing and Storage

We process and store Your Content and related data in accordance with our Privacy Policy and applicable data protection laws. Data may be processed in the United States or other jurisdictions where we or our service providers operate. By using the Service, you consent to such transfer and processing.

4.3 Data Retention and Deletion

5. Subprocessors and Third-Party Services

These providers process data on our instructions and are bound by contractual obligations consistent with these Terms and applicable privacy laws. A list of key subprocessors is available upon request. We remain responsible for our subprocessors’ handling of your data.

6. Intellectual Property

The Service, including its design, software, branding, and documentation, is owned by Fig AI Systems LLC or its licensors and is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted by us. AI-generated outputs provided to you are licensed for your use in connection with the Service as delivered; we do not claim ownership of custom outputs created for you, subject to the license you grant us in Section 4.1.

7. Fees and Payment

Currently, the Service may be offered as a free demo or under separate pricing. If we introduce fees, we will notify you and you may be required to agree to additional payment terms. All fees are in U.S. dollars unless otherwise stated. Refunds are subject to our then-current policy.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI OUTPUTS MAY BE INACCURATE, INCOMPLETE, OR UNSUITABLE FOR YOUR USE; YOU RELY ON THEM AT YOUR OWN RISK.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIG AI SYSTEMS LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Fig AI Systems LLC and its affiliates, officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms or any law; or (d) your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (including 4.1 to the extent of prior grants, 6, 8, 9, 10, and 12) will survive termination.

12. General

These Terms constitute the entire agreement between you and Fig AI Systems LLC regarding the Service. They are governed by the laws of the State of Delaware, without regard to conflict of laws principles. Any dispute shall be resolved in the state or federal courts located in Delaware. Our failure to enforce any right does not waive that right. If any provision is held invalid, the remaining provisions remain in effect. We may assign these Terms; you may not assign without our prior written consent.
